Welcome to Tesha.online (“Tesha”, “we”, “us” or “our”).

These Terms of Use (“Terms”) govern your access to and use of the Tesha.online website, platform, services, content and features.

By accessing or using Tesha, you agree to comply with these Terms. If you do not agree with these Terms, please do not use the website.

These Terms should be read together with our Privacy Policy, which explains how we collect, use and protect personal information.

1. About Tesha

Tesha is a Botswana-focused online platform that provides access to employment, procurement and business opportunities.

Our services may include:

  • Job listings
  • Recruitment opportunities
  • Tender listings
  • Requests for Quotations (RFQs)
  • Requests for Proposals (RFPs)
  • Expressions of Interest (EOIs)
  • Consultancy opportunities
  • Grants and funding opportunities
  • Business opportunities
  • Career-related information
  • Employer and organisation profiles
  • User accounts
  • Job application functionality
  • Other related information and services

Tesha is primarily an information and opportunity platform.

Unless expressly stated otherwise, Tesha is not the employer, recruiter, tender issuer, contracting authority or awarding organisation associated with an opportunity published on the platform.

2. Acceptance of These Terms

By accessing or using Tesha, you confirm that:

  1. You have read and understood these Terms;
  2. You agree to be bound by them;
  3. You will comply with applicable laws and regulations;
  4. You will provide accurate information where information is requested;
  5. You will use the website only for lawful purposes.

If you are using Tesha on behalf of an organisation, you confirm that you have authority to accept these Terms on behalf of that organisation.

3. Eligibility

You must be legally capable of entering into an agreement under applicable law to use services that require registration or contractual participation.

If a particular service has additional eligibility requirements, those requirements may be stated on the relevant page or application process.

We may restrict or terminate access where we reasonably believe that a user does not meet applicable eligibility requirements.

4. User Accounts

Certain Tesha features may require registration.

When creating an account, you agree to:

  • Provide accurate and current information;
  • Keep your account information updated;
  • Keep your username and password confidential;
  • Not share your account with another person;
  • Not impersonate another person or organisation;
  • Not create accounts for fraudulent or abusive purposes;
  • Notify us if you suspect unauthorised access to your account.

You are responsible for activity conducted through your account unless the activity resulted from circumstances outside your reasonable control.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Jobs and Employment Opportunities

Tesha may publish job vacancies submitted by employers, recruiters, organisations or other third parties.

Tesha does not guarantee:

  • That a vacancy is genuine;
  • That a vacancy remains available;
  • That an employer will respond to an application;
  • That an applicant will be shortlisted;
  • That an applicant will be interviewed;
  • That an applicant will be employed;
  • The accuracy of information supplied by an employer;
  • The salary, benefits or employment conditions described in a listing.

Employers and other vacancy providers are responsible for the accuracy and legality of information they submit.

Users should independently verify important information before accepting employment or providing sensitive information to an employer.

6. Job Applications

Where Tesha provides an application function, submitting an application does not guarantee employment or any response from the employer.

You are responsible for ensuring that information included in your application is:

  • Accurate;
  • Truthful;
  • Relevant;
  • Lawful;
  • Not misleading.

You must not submit another person’s CV, qualifications, identity information or other personal information without appropriate authority.

Tesha may transmit application information to the employer or organisation associated with the relevant vacancy.

7. Employers and Recruiters

Employers, recruiters and organisations posting opportunities on Tesha agree that information they provide must be accurate and lawful.

They must not use Tesha to:

  • Publish fraudulent vacancies;
  • Mislead candidates;
  • Discriminate unlawfully;
  • Request inappropriate payments from candidates;
  • Collect personal information for unrelated purposes;
  • Impersonate another organisation;
  • Publish misleading employment conditions;
  • Promote illegal activities;
  • Engage in scams or fraudulent recruitment practices.

Tesha may remove listings or suspend accounts where there are reasonable grounds to believe that these Terms have been violated.

8. Tenders and Procurement Opportunities

Tesha may publish information about:

  • Government tenders;
  • Private-sector tenders;
  • RFQs;
  • RFPs;
  • EOIs;
  • Consultancies;
  • Grants;
  • Procurement opportunities;
  • Other business opportunities.

Tesha generally acts as an information platform and does not ordinarily issue or award the opportunities displayed on the website.

The organisation identified as the issuing organisation is responsible for the official tender, procurement process, requirements, deadlines and award decisions.

Users should always consult the official tender document and issuing organisation before submitting a bid or making any payment.

9. Tender Accuracy and Changes

Although Tesha may take reasonable steps to present opportunity information accurately, information may change after publication.

A tender may be:

  • Amended;
  • Extended;
  • Cancelled;
  • Withdrawn;
  • Replaced;
  • Closed earlier or later than originally stated.

Tesha does not guarantee that every listing will reflect the latest information at all times.

Where a tender is important to your business, you should verify the information with the issuing organisation or official source.

10. No Guarantee of Opportunities

Tesha does not guarantee that:

  • A particular job will result in employment;
  • A tender will result in a contract;
  • A bid will be successful;
  • An employer will contact an applicant;
  • An organisation will respond to an enquiry;
  • A particular opportunity will remain available;
  • Information will always be complete or current.

Tesha provides access to information and platform functionality but does not control the decisions of employers, recruiters, government institutions, tender issuers or other third parties.

11. User Content

Users may submit content to Tesha, including:

  • CVs;
  • Profiles;
  • Job applications;
  • Job listings;
  • Company information;
  • Tender information;
  • Comments;
  • Messages;
  • Documents;
  • Images;
  • Other materials.

You retain ownership of content that you lawfully own.

By submitting content to Tesha, you grant Tesha the limited rights reasonably necessary to host, store, process, display, transmit and make that content available for the purpose for which you submitted it.

You are responsible for ensuring that you have the necessary rights and permissions to submit the content.

  • Attempts to defraud users;
  • Contains unlawful discriminatory material;
  • Attempts to obtain passwords or account credentials;
  • Is intended to compromise the security of Tesha;
  • Violates applicable Botswana law or other applicable law.

We may remove content that we reasonably believe violates these Terms or applicable law.

13. Prohibited Use of the Website

You must not:

  • Attempt to gain unauthorised access to Tesha;
  • Circumvent security controls;

  • Layouts;
  • Software;
  • Code;
  • User-interface elements;
  • Database structures;
  • Other original materials.

You may access and use Tesha for legitimate personal or business purposes in accordance with these Terms.

You must not reproduce, modify, distribute, sell, license or commercially exploit Tesha’s proprietary materials without appropriate permission, except where permitted by law.

15. Third-Party Content

Tesha may display or link to content supplied by third parties.

Third-party content may include:

  • Job advertisements;
  • Employer information;
  • Tender information;
  • Government notices;
  • Company information;
  • Documents;
  • External links;
  • Images and logos.

Tesha does not necessarily endorse or independently verify all third-party content.

The third party that supplies the content remains responsible for it.

16. External Links

Tesha may provide links to external websites.

External links are provided for convenience and information.

We do not control third-party websites and are not responsible for:

  • Their content;
  • Their availability;
  • Their security;
  • Their privacy practices;
  • Their terms;
  • Their transactions;
  • Their products or services.

You access external websites at your own discretion.

17. Payments and Fees

Some opportunities or services may involve fees charged by an employer, tender issuer, government institution or other third party.

Unless expressly stated otherwise, Tesha is not responsible for payments required by third parties.

Users should independently verify payment instructions before making payments.

Tesha will not knowingly request payment from job applicants merely to access a legitimate employment opportunity unless a specific paid service is clearly identified.

18. Fraud and Scam Prevention

Users should exercise caution when interacting with employers, recruiters, tender issuers and other third parties.

Never provide:

  • Banking passwords;
  • PINs;
  • One-time passwords;
  • Credit-card security codes;
  • Account passwords;
  • Other sensitive security credentials

to a person claiming to represent Tesha unless you have independently verified the request.

If you encounter suspicious content or believe that a listing may be fraudulent, contact us at info@tesha.online.

19. Privacy and Personal Information

Your use of Tesha is also subject to our Privacy Policy.

Tesha processes personal information in accordance with applicable Botswana data-protection requirements, including the Data Protection Act, 2024.

The Act regulates the protection of personal data and provides rights and obligations relating to the processing of personal information. It applies to relevant data controllers and processors, including certain organisations operating outside Botswana where the statutory conditions are met.

Our Privacy Policy explains:

  • What personal information we collect;
  • Why we collect it;
  • How we use it;
  • How we protect it;
  • When it may be shared;
  • How long it may be retained;
  • Your applicable data-protection rights.

20. Data Protection Responsibilities of Users

If you upload, submit or otherwise provide personal information belonging to another individual, you are responsible for ensuring that you have an appropriate legal basis and authority to do so.

For example, employers should ensure that CVs, applicant information and other personal information submitted to Tesha are handled lawfully.

Users must not use Tesha to unlawfully collect, disclose, sell or misuse another person’s personal information.

  • Breach of these Terms;
  • Unlawful use of Tesha;
  • Violation of another person’s rights;

The remaining provisions will continue to apply.

29. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce that provision later.

30. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms expressly applicable to specific Tesha services, constitute the agreement governing your use of the relevant Tesha services.

Where additional terms apply to a specific service, those terms will take precedence to the extent of any inconsistency.
